Corporate Raiding Through State Mechanisms: A Comparative Analysis of Kazakhstan, Russia, and Ukraine
Published: March 19, 2026
Author: Khrabrykh S. A.

This ARGA report systematically analyzes corporate raiding implemented through formally legal state mechanisms: corporate registration, real estate rights registration, bankruptcy, enforcement proceedings, and criminal process. It compares the legal architectures of Kazakhstan, Russia, and Ukraine, including Ukraine’s anti-raiding administrative framework. ARGA experts demonstrate that the key dispute in such cases concerns not only assets but also control over the state’s procedural infrastructure. A practical defense model is proposed, covering registration, procedural, bankruptcy, criminal law, and international tracks.
