This report is a core analytical document prepared by the ARGA Observatory, based on the systematic reconstruction of a vast body of corporate, registration, judicial, and property records (the Master Dossier) concerning “TPK Asia” LLP. The document details the history of the company from its establishment in 2000, its development into a major regional fuel infrastructure enterprise (managing up to 96 petrol stations and 8 oil depots), and the subsequent loss of corporate control by its founding partners in 2002–2003. This shift culminated in the absolute consolidation of ownership by Aliya Nazarbayeva, followed by a sequence of nominal ownership transfers, the complete dismantling and sale of the asset portfolio, the forced bankruptcy of its branches, and the final liquidation of the entity in 2011.
The second section details the national phase of legal defense initiated in the Republic of Kazakhstan (2024), which highlighted systemic limitations within the domestic legal framework—including the depletion of state archives and the inability to trace offshore-redirected capital. Consequently, this report justifies the transition of the project to its international legal phase, focusing on cross-border financial monitoring, enhanced due diligence (EDD) compliance, beneficial ownership disclosures, and international asset tracing. Maintaining a strictly factual and neutral stance, the report avoids definitive legal culpability findings. Instead, it serves as a foundational factual source to draft specialized legal and compliance memoranda for international regulatory bodies, financial institutions, and law enforcement agencies to facilitate either a negotiated settlement or asset recovery efforts, with the total disputed portfolio valued by the principals at approximately USD 170 million.
