Lawyer Responsibility in International Cases and the Limits of the Mandate

This ARGA report systematically analyzes lawyer responsibility in international cases and the limits of their professional mandate. Key obligations are examined: independence, competence, loyalty to the client, confidentiality, and compliance with forum-specific rules. Based on UN Basic Principles, ECtHR practice, and the ICC Code, ARGA experts demonstrate where mandate limits lie: the prohibition of identifying lawyers with their clients, conflict of interest management, limits on disclosure, and disciplinary accountability. A practical model for mandate management in cross-border procedures is proposed.
