Доклад посвящён процедурам исключения физических и юридических лиц из санкционных списков США, Великобритании и Европейского союза. Центральная проблема заключается в том, что делистинг не сводится к заявлению о невиновности, тяжёлых последствиях санкций или положительной репутации заявителя. В большинстве рассматриваемых режимов включение в список не требует уголовного приговора, поэтому эффективная стратегия должна отвечать непосредственно на юридический критерий санкционного решения: показать, что он не был выполнен изначально, перестал выполняться вследствие изменившихся обстоятельств либо решение было принято с нарушением применимых процедурных требований.

Исследование разграничивает административные и судебные механизмы в трёх юрисдикциях. В США рассматриваются пересмотр OFAC, получение доступных материалов, работа с дополнительными вопросами ведомства и возможный последующий судебный контроль. Для Великобритании анализируются компетенции FCDO, министров и OFSI, а также порядок судебной проверки. В части ЕС исследуются пересмотр Советом ЕС, обращение в Общий суд, продление санкционных актов и временные меры. Особое внимание уделено тому, что положительное решение в одной юрисдикции не прекращает ограничения, действующие в другой.

Доклад выделяет три основные линии защиты: первоначальную ошибку при включении, последующее изменение обстоятельств и процессуальные нарушения. Для каждой необходимо собственное доказательственное основание. Отставка, продажа доли, изменение структуры управления или прекращение финансирования оцениваются не только по формальным документам, но и по фактическому исполнению: сохраняющимся полномочиям, экономическим выгодам, правам подписи, договорным отношениям и иным механизмам влияния. Если санкционное решение опирается на несколько самостоятельных критериев, каждый из них должен быть рассмотрен отдельно.

Отдельно анализируется различие между делистингом, лицензированием, судебной отменой конкретного акта и исправлением ошибочной идентификации. Разрешение провести отдельную операцию не означает снятия санкций, а отмена акта за определённый период не гарантирует отсутствия последующих ограничений. Даже после исключения из списка активы могут оставаться заблокированными по другому санкционному режиму, судебному основанию или вследствие самостоятельной AML/CFT-проверки банка.

Практический подход ARGA строится вокруг матрицы «критерий — утверждаемый факт — доказательство — возражение», общей хронологии и отдельного процессуального календаря для каждой юрисдикции. Главный вывод исследования состоит в том, что результат делистинга следует оценивать не по формулировке одного решения, а по его реальным последствиям: изменению официальной записи, освобождению активов, возможности совершать разрешённые операции и устранению оставшихся ограничений.

Sanctions Delisting: United States, United Kingdom and European Union

The report examines procedures for removing individuals and entities from sanctions lists in the United States, the United Kingdom and the European Union. Its central point is that delisting is not simply a claim of innocence, hardship or good reputation. In many sanctions regimes, designation does not depend on a criminal conviction. An effective challenge must therefore address the legal criterion underlying the designation and demonstrate that it was never satisfied, is no longer satisfied because circumstances have changed, or was applied through a decision affected by a relevant procedural defect.

The report compares the administrative and judicial routes available in the three jurisdictions. In the United States, it considers OFAC reconsideration, access to available supporting material, responses to additional agency questions and possible judicial review. In the United Kingdom, it examines the respective roles of the FCDO, ministers and OFSI, together with the judicial-review framework. For the European Union, the analysis covers reconsideration by the Council, proceedings before the General Court, renewal of restrictive measures and interim relief. A recurring theme is that success in one jurisdiction does not automatically remove sanctions imposed elsewhere.

Three principal grounds of challenge are distinguished: original error, subsequent change of circumstances and procedural failure. Each requires its own evidential foundation. Resignation, disposal of a shareholding, changes in corporate governance or termination of financial support must be demonstrated in practice rather than merely on paper. Continuing powers, economic benefits, signing authority, contractual arrangements and other forms of influence may remain relevant. Where a designation rests on several independent criteria, every sufficient ground must be addressed separately.

The report also distinguishes delisting from licensing, judicial annulment of a particular measure and correction of mistaken identity. Permission to carry out a specific transaction is not equivalent to removal from a sanctions list, while annulment of an earlier act may leave later measures intact. Even after delisting, assets may remain restricted because of another sanctions regime, a court order or an independent AML/CFT decision by a financial institution.

ARGA’s practical approach is organised around a matrix linking the legal criterion, alleged fact, evidence and response, supported by a common factual chronology and separate procedural calendars for each jurisdiction. The broader conclusion is that delisting should be measured by its actual implementation rather than by favourable wording alone: the official record must change where appropriate, assets must become operationally accessible, permitted transactions must be executable, and any remaining restrictions must be identified and addressed separately.
